It's Microsoft's fault, not HMX's. RBN uses XNA, Microsoft's framework for selling independently produced content on the 360. Right now only some countries can buy content from XNA, and Mexico is not one of them.

Rock Band Network is based on the XNA development platform. However, the distribution of songs is based on the Xbox LIVE Indie Games setup.

To quote from the XNA Creators Club FAQ:
Consumers in the United States, Canada, United Kingdom, France, Italy, Germany, Japan, Sweden, Singapore and Spain are able to download Xbox LIVE Indie Games for purchase. We are continually working to add additional regions.
Which I believe is also the current list of countries which can actively purchase content from RBN. It's not particularly fair, but it's not HMX's fault either. Microsoft has to make such things available in other countries and that's not always going to be easy depending on local laws.

Some people have said they have had success with creating a XBL account in a qualified country, purchased valid points from that country, and then downloaded the song. You may wish to check into that if you're not willing to wait.
